Terms and Conditions

These terms and conditions of service (“Terms”) govern the provision of the Service by RealCalls to its Customer (“You”).

By using the Service, You agree to be bound by these Terms in their entirety and these Terms form the basis of the agreement between You and RealCalls for the Service.

1. Service
The Service offered is indirect telephony such as regular national and/or international telephone calls made via your Broadband connection routed by RealCalls.

You confirm your order for the Service by completing the registration form on the RealCalls Website (www.RealCalls.com). RealCalls has the right to accept only certain credit or charge cards and to perform a credit check to determine credit worthiness, and whether the credit or charge card is valid before accepting You as a customer. Cards accepted by RealCalls are stated on the RealCalls website.

This agreement shall enter into effect on the date that you receive a communication of RealCalls’s acceptance.

2. Duration
You or RealCalls are entitled to cancel this agreement at any time without any specific reason by written notice.

You shall remain liable for all charges incurred by You until such written cancellation is received by either You or RealCalls. If cancelled by you, the written cancellation requested must be sent to RealCalls at: RealCalls, Suite 2273, Chynoweth House, Trevissome Park, Truro, TR4 8UN, UK. If cancelled by RealCalls, the cancellation will be notified to You by e-mail do support@realcalls.com.

3. Payments
RealCalls is a pre-payment service, with payments accepted by PayPal, Credit or Debit cards. Invoices will be issued automatically by email following payment.

RealCalls will post all charging rates in its “pricelist” at its website www.RealCalls.com. Any rate increase will be posted no less than seven days before taking effect. It is your responsibility to keep up to date with the “pricelist” and latest tariffs as the call will be billed according to “pricelist” section. A connection charge of 5p is charged for every connected call. You may at any time inspect the price list and latest tariffs at RealCalls’s website.

4. Your responsibilities
It is your responsibility to report faults or disturbances in the Service to RealCalls by sending an e-mail via the ‘Support’ link on the RealCalls website. RealCalls will take all reasonable measures to correct the problem as soon as possible.

You must:

  1. ensure that your account has enough calling credit to make outbound calls.
  2. not use the Service to: 
    1. make any hoax call to emergency services or transmit defamatory, offensive, abusive, obscene or menacing material;
    2. violate or infringe the rights of others; or
    3. commit fraud or any criminal offence.
    4. not disclose any password or account number allocated to or chosen by You for access to the Service to any person other than an employee of RealCalls, or a person authorised by You.
    5. inform RealCalls immediately of any suspected unauthorised use of the Service.
    6. indemnify RealCalls against all liabilities, claims, damages, losses and expenses arising from any breach of these Terms and /or the use of the Service.

RealCalls reserves the right:

  1. to terminate a call and/or your further use of the Service at once when Your Pre-Payment amount falls to zero.
  2. to terminate automatically without notice any call lasting 2 hours or longer. 
  3. to vary its tariffs without notifying You personally.

5. Liability
You acknowledge that the Service provided by RealCalls is a low cost cut-price telephony service provided on an “as is” basis for your use and which you are free to cancel at any time. Accordingly you acknowledge and agree that having read and understood these Terms, they and any limitations in them, are agreed by You to be fair and reasonable in all the circumstances that affect RealCalls’s provision of the Service.

You will be liable at all times for all calls, whether authorised or unauthorised, made from your registered numbers, in accordance with our call records, unless such unauthorised use is wholly attributable to an act or omission of RealCalls.

RealCalls warrants that it will provide the Service with reasonable care and substantially as described in these Terms. RealCalls does not make any other promises or warranties about the Service. RealCalls will not be liable for any loss or damages arising out of the Service. RealCalls shall be not be liable for any indirect or consequential loss or damage arising out of this agreement. RealCalls shall not be liable for any loss or damage arising in connection with interrupted telephone calls or connections, lost telephone messages, delays or any other interference in the Service, or additional costs for having to redirect traffic to another operator.

Any issue as to any invoice or the Service, must be notified by You to RealCalls within 3 months from the cause of issue arising.

You will be at all times responsible for maintaining the confidentiality and security of your password and user-id, and will be fully responsible for all activities that occur under your password and user-id.

6. Transfer
This agreement is personal between you and RealCalls and no third parties shall derive any rights under it or be entitled to enforce any of its terms.

You may not assign your agreement with RealCalls to another party without our written permission. RealCalls may assign this agreement to another party for the purpose of providing the Service by written confirmation to you (e-mail is acceptable as written confirmation).

7. Law and Jurisdiction
This agreement shall be governed by and construed in accordance with English law and the parties agree to submit to the exclusive jurisdiction of the English courts.

All claims to RealCalls must be made in writing to the RealCalls address in clause 8 below.

8. Change of General Terms and Conditions
RealCalls may vary these general Terms at any time due to prevailing conditions affecting the provision of the Service, by posting the changes at least ten days in advance on the RealCalls website (www.RealCalls.com).

If you do not accept such changes You have the right to cancel the agreement with RealCalls with immediate effect by written notice to RealCalls within the notice period before the changes take effect. Cancellation requests must be made in writing and be sent to RealCalls at: RealCalls, Suite 2273, Chynoweth House, Trevissome Park, Truro, TR4 8UN, UK

9. Entire understanding
These Terms represent the entire understanding between You and RealCalls. All other prior or contemporary written or oral agreements, understandings, communications or practices shall be superseded and of no effect.

10. Data
RealCalls may process traffic data relating to Your use and that of other users lawfully stored by RealCalls for the purposes of marketing RealCalls’s products and services.
You agree not to reproduce, copy, sell, resell or exploit for any commercial purpose any part of, use of or access to the Service or the RealCalls website.

11. No waiver
No failure by either party to enforce any right under these Terms and Conditions shall be construed as a waiver of such right or any other rights. If any part or parts of these Terms are found to be invalid, the remainder of these Terms will remain in force.

12. Other websites
RealCalls has no control over other websites and resources that You may access via its website. You acknowledge and agree that RealCalls is not responsible for the availability of such external third party websites or resources and that RealCalls does not specifically endorse or bear any responsibility or liability for any specific product, content, advertising or other items on or made available by such websites or resources.
